1. Introduction

2XD provides email marketing consulting services, including but not limited to strategy development, campaign management, analytics, and optimization. Our services are designed for businesses and professionals seeking to enhance their email marketing effectiveness. While we strive to deliver exceptional results, we cannot guarantee specific outcomes as success depends on various factors, including market conditions and implementation.
We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice. We may also impose limits on certain features or restrict access to parts or all of the service without liability or notification.
3. Account Registration and Security
When you create an account with us, you must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We implement reasonable security measures, but we cannot guarantee absolute security.
You agree to:
- Immediately notify us of any unauthorized use of your account or security breaches
- Ensure proper logout from your account at the end of each session
- Use strong, unique passwords and update them regularly
- Not share your account credentials with third parties
4. Client Responsibilities
As a client of 2XD, you acknowledge and agree that successful email marketing requires collaboration. You are responsible for providing timely feedback, necessary materials, and accurate information for your campaigns. You must ensure that all content provided complies with applicable laws and regulations, including but not limited to anti-spam laws, data protection regulations, and intellectual property rights.
5. Payment Terms
Our service fees are based on the scope of work agreed upon in your service contract. Payment terms are net 30 days unless otherwise specified. We accept major credit cards and bank transfers. Late payments may result in service suspension and will incur a 1.5% monthly interest charge on outstanding balances.
Price changes will be communicated with at least 30 days' notice. Ongoing services will be billed at the new rate after the notice period. You may terminate services if you do not agree to the new pricing structure, subject to our cancellation terms.
6. Intellectual Property Rights
The content on our website and in our services, including but not limited to text, graphics, logos, images, and software, is the property of 2XD or our licensors and is protected by intellectual property laws. While we grant you access to use our services, this does not transfer any ownership rights.
For content you provide to us, you grant 2XD a worldwide, non-exclusive license to use, store, and process the content for the purpose of providing our services. You represent and warrant that you have all necessary rights to grant this license.
7. Confidentiality
We understand the sensitive nature of marketing strategies and business information. Any confidential information shared during our engagement will be protected and used solely for the purpose of providing our services. Our confidentiality obligations survive the termination of our service agreement.
8. Service Level Expectations
We strive to maintain high service standards and will make commercially reasonable efforts to ensure our services are available and effective. Our normal business hours are Monday through Friday, 9:00 AM to 5:00 PM Pacific Time. Response times for support requests are as follows:
- Critical issues: Within 2 business hours
- Standard requests: Within 1 business day
- General inquiries: Within 2 business days
9. Limitation of Liability
2XD provides services on an "as is" and "as available" basis. While we strive for excellence, we make no warranties, express or implied, regarding the performance of our services. Our liability is limited to the amount paid for services in the preceding three months.
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising out of or relating to the use of our services.
10. Termination
Either party may terminate services with 30 days written notice. Immediate termination may occur in cases of material breach, including but not limited to non-payment, violation of these terms, or illegal activities. Upon termination, you remain responsible for any outstanding payments, and we will provide reasonable assistance in transitioning your services.
11. Force Majeure
Neither party shall be liable for any failure or delay in performance due to circumstances beyond reasonable control, including but not limited to acts of God, war, strikes, lockouts, riots, acts of terrorism, pandemic, internet service provider failures, or governmental actions.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Washington State, United States. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Vancouver, Washington.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Continued use of our services after any modifications indicates your acceptance of the updated Terms. We will notify clients of material changes via email.

15. Unsubscribe
You may unsubscribe from our marketing communications at any time. All marketing emails contain an unsubscribe link in the footer, or you can visit our unsubscribe page. After clicking unsubscribe, your request will be processed immediately, though it may take up to 48 hours to fully take effect across all our systems. Even after unsubscribing from marketing communications, you may still receive essential service-related communications, such as billing notifications, technical updates, or changes to our terms or policies. 16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary while preserving the remaining provisions in full force and effect.
